Before subscribing to our services and when you access the Website, you agree to be bound by the Terms and Conditions set out below. Please read the Terms and Conditions carefully. We may change these terms and conditions at any time by updating this page. You should check this page from time to time to ensure that you are happy with any changes. If you do not accept these Terms and Conditions, please do not continue to use the Website. For ease of reference we recommend that you print a copy for your own records.
All applications are subject to status and all applicants must be over 18 years of age. The purchase of your Subscription Service is subject to a minimum 12 month contract with menusin.com. Please ensure that you have recorded all of your details accurately as your order may be delayed if we need to contact you for clarification. We hope that you will be happy with your experience but should you cancel your subscription within the term of your contract, fail to settle your account or we are obliged to terminate your subscription for any reason we reserve the right to charge you the full cost of the annual subscription outstanding.
1.0: Definitions

1.4: ‘menusin.com” means the trading name of Menusin.com.Limited and its subsidiaries, associates, affiliated trading subsidiaries, and assigns including, inter alia, menusin.swindon; menusinoxford, etc.
1.5: ‘Minimum Period’ means the first twelve months of the Service (or any alternative period agreed in the order.)
1.6: “the Site” means the home page and the sub-domain pages of the menusin.com website and related sub site www.menusinswindon.com, and any other variation of such are owned by Menus in.com Ltd ("Menusin.com") or other parties.
1.7: ‘Website User Conditions’ means such terms and conditions as the Supplier may determine from time to time governing the use of the various menusin.com affiliated websites and are deemed to have been accepted by you and deemed to be included in any subscription request accepted by menusin.com.

1.10: In these conditions the term male shall include the female, the singular shall include the plural, etc. and vice versa unless the context requires otherwise.
1.11: In the event of any conflict these terms and conditions shall take precedence over the abridged terms and conditions on the Order
1.12: The heading of each condition shall not affect the interpretation thereof.
1.13: ‘Privacy Policy’ means the commitment of menusin.com towards safeguarding the privacy of our website users and visitors.
2.0: General
2.1: These terms and conditions of sale apply to all services provided by us.
2.2: We may change these terms and conditions of sale without notice to you in relation to future sales.
2.3: The agreement is subject to your right of cancellation but you cannot transfer or try to transfer this agreement or any part of it to anyone else.
2.4: We reserve the right the decline any subscription for any reason.
3.0: Description of the Services - The description and price of the services to which you subscribe will be as shown on the prevailing price list and our website at the time you place your order.
4.0: Permitted Use

4.5: You hereby grant Menusin.com a non-exclusive, royalty-free, perpetual and worldwide licence to republish any material you submit, post, upload, e-mail or otherwise transmit to them or to the Site in any format, including without limitation print and electronic format.
4.6: You hereby waive all of the moral rights that you have under Chapter IV of the of the Copyright, Design and Patents Act 1988 in respect of any material you submit, post, upload, email or otherwise transmit to Menusin.com or to the Site.
4.7: You confirm that you are at least 18 years of age, or, if under 18, that you are accessing the Site with full parental / guardian consent.
5.0: Price of the Services
5.1: All prices shown are in £ British Pounds Sterling
5.2: Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.
5.3: In addition to the price, you may be required to pay Value Added Tax (VAT) and any other applicable taxes
6.0: Payment Terms
6.1: Payment for the Service(s) can be made by any method shown on our website at the time you place your Order.
6.2: Payment shall be due before the date for commencement of Service.
6.3: Service(s) will not be provided until cleared funds are received.
7.0: Term of Subscription
7.1: Subscription to the Service shall be for a Minimum Period of one year from date of commencement and thenceforward on an annual renewal basis subject to timely payment of the appropriate annual subscription or unless the Service Subscription is terminated by us in accordance with these terms and condition.
7.2: Except as expressly set out in the Service Subscription or related Order, any renewal of Service Subscription and subsequent acceptance by us shall be at menusin.com’s sole discretion. The rates applicable to such renewal period (if any) are subject to change by menusin.com from time to time in its absolute discretion.
7.3: This agreement, or the supply of the Service, can be ended by:
one month’s notice from us to you; or
one month’s notice from you to us (provided the minimum term of 12 months has been met).
7.3a: If we give notice, you must pay the Service Subscription to the end of that notice. If you give us notice, you must pay the Service Subscription until we receive your notice or until the end of the notice if that is later.
7.3b: If you give us notice (other than because we have increased our charges or materially changed the conditions of this agreement to your detriment) such that the Service period ends during the Minimum Period, you must pay us the charges for in full for the Minimum Period.
7.3c: If you have paid any rental for a period after the end of the agreement, we will either repay it or put it towards any money you owe us.
7.4: You must pay all charges for the Service until the date on which we stop providing Service to you.
7.5: We can end this agreement at any time without notice if you break the agreement or if you cease to meet the eligibility conditions,
7.6: Subscriptions are non-refundable except as specifically provided for above.
8.0: Client Obligations
8.1: You are responsible for obtaining all necessary software and equipment that is required to be able to access the Service.
8.2: You agree to observe the Menusin.com Website User Terms & Conditions.
8.3: You hereby grants a world-wide non-exclusive, fully paid licence to reproduce and display menus and other related data supplied to menusin.com (including all contents, trademarks and brand features contained therein) for any purpose in accordance with the terms and conditions of the subscription service.
8.4: Except as otherwise expressly provided in the subscription service, positioning of display menus and other related materials and/or data supplied to menusin.com within the menusin.com publications or on any website page will be at the sole discretion of menusin.com who will not be prohibited from also carrying menu displays and advertisements competitive to your product or business.
8.5: Menusin.com does not warrant the date or dates of insertion of any menu information or other related data and does not warrant that this information will not be displayed after any end date specified. However, menusin.com will use reasonable efforts to comply with your wishes in this regard.
8.6: We may use the information we have about you and you grants to menusin.com the express right to reproduce throughout the world screen shots of all or part of any menusin.com publications containing all or part of the display materials supplied by you to menusin.com on or in any promotional or advertising material or campaign promoting or advertising menusin.com.
9.0: Supplier Obligations
9.1: The service we supply to you is the ability to list and update your menu and other data relating to your restaurant or catering outlet on menusin.com or its subsidiary URL defined websites. The service does not include the supply of any equipment or software. You may opt to subscribe to various incremental Service Packs which allow us to maintain your web page(s) for you.
9.2: In providing the Service we promise to use reasonable skill and care to the standard expected of a competent website service provider.
9 .3: The Service may be affected by a number of things such as:
9.3a: changes to the way the Service works for operational reasons;
9.3b: interruptions to the service for operational exigencies or because of an emergency;
9.3c: giving you instructions that we believe are necessary for health and safety, or for the quality of service that we supply to you or our other customers;
9.3d: and may be subject to occasional interruption due to circumstances beyond our control. We will use reasonable endeavours to provide you with the Service by the date we agree with you but we have no liability for any failure to do so.
9.4: Menusin.com cannot guarantee your use of the website will be free from error and/or uninterrupted or that you will not experience failure of the Service. If the website service or availability is interrupted for whatever reason we will restore it as quickly as we can. You should report any faults to menus.com as soon as possible to enable us to do this.
9.5: Menusin.com can suspend the Service or end the agreement (or both) at any time without notice if:
9.5a: you break this agreement or any other agreement you have with us and fail to remedy the breach within a reasonable time if asked to do so;
9.5b: we believe the Service is being used in a way forbidden in these terms and conditions even if you were unaware that the Service was being used in this way;
9.5c: bankruptcy of insolvency proceedings are brought against you, or if you do not make any payment under a judgement of Court on time, or you make an arrangement with your creditors or a receiver or administrator is appointed over any of your assets, or you go into liquidation.
9.6: If we suspend the Service because you break this agreement, the agreement will still continue and you must continue to pay any sums outstanding until the agreement is ended by us by giving notice under these terms and conditions.
10.0: Changes to the Service
10.1: If you ask us to make any change to the Service we may ask you to confirm your request in writing. If we agree to the change, this agreement will be changed when we confirm the change to you in writing.
11.0: Subscriptions, Email, Newsletters, etc.
11.1: Where you are required to register with menusin.com online as a condition of using the Website or sending / receiving communications, emails, newsletters, etc. by email you agrees to provide true, accurate, current and complete information about yourself as requested by menusin.com in the registration or subscription form. You agree to maintain and properly update such information to keep it true, accurate, current and complete.
12.0: Limitation of Liability
12.1: Notwithstanding any other provision in these Terms, nothing in these Terms & Conditions will affect or limit your rights as a consumer under English law; or will exclude or limit our liability for death or personal injury resulting from our negligence.
12.2: The Website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided to by you. You must bear the risk associated with the use of the Internet.
12.3: Whilst we will try to ensure that material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. If we are informed of any inaccuracies in the material on the Website we will attempt to correct this as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following:
12.3a: incompatibility of the Website with any of your equipment, software or telecommunications links;

12.4: To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (both of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Website.
12.5: Furthermore we shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, pure economic loss, depletion of goodwill, loss of anticipated savings, wasted expenditure, loss of privacy, loss of data, or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the provision of Services under this agreement.
12.6: Notwithstanding the foregoing provisions our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the amount of subscription paid for the Service.
13.0: Force Majeure
13.1: Menusin.com will not be liable to do what we have promised in this agreement because of something beyond our reasonable control such as (but not limited to) lightning, flood, or exceptionally severe weather, fire or explosion, civil disorder, war or military operations, national or local emergency, anything done by government or other competent authority or industrial disputes of any kind including those involving our employees).
14.0: Misuse
14.1: Nobody must use the website Service in any way:
14.1a: that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.
14.1b: which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
14.1c: for any purposes related to marketing without our express written consent.

17.2: You may be requested to take part in promotional activity and Menusin.com reserves the right to use the names, addresses of clients, their photographs and audio / visual recordings of them in any publicity.
17.3: All personal data relating to you will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent.
18.0: Intellectual Property
18.1: The content of the Website is protected by copyright, trade marks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors. 25.1: The parties to this agreement are independent businesses and nothing in this agreement or by virtue of performing it shall be taken as creating a relationship of agent to principal, employer to employee, partnership or joint venture between you and us. Neither party shall be entitled to enter into agreements or other arrangements on behalf of the other and is it intended that both parties shall retain their independence.
26.0: Law and Jurisdiction
26.1: These terms of sale and the supply of the Services will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
26.2: The menusin.com Website is controlled and operated in the United Kingdom. The terms of use will be governed by the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the English courts.
